BY ACCESSING OR USING THIS WEBSITE OR ANY SERVICES PROVIDED BY INSTITUTIONAL TRADING ACADEMY (ITA), YOU IRREVOCABLY AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE, YOU ARE PROHIBITED FROM ACCESSING OR USING THE SITE OR SERVICES.
1. Overview and Scope
This website (the “Site”) and all associated services (collectively, the “Services”) are operated by Institutional Trading Academy (ITA). Access to and use of the Site and Services are expressly conditioned upon your full acceptance of these Terms. ITA reserves the absolute right, at its sole discretion, to modify, suspend, or terminate the Site, Services, or these Terms at any time, with or without notice.
DISCLAIMER: The Services are exclusively for simulated trading evaluations and do not constitute investment services, advice, or opportunities under any applicable law. ITA does not provide, and is not authorized to provide, investment guidance, recommendations, or instructions.
The Services are restricted to individuals aged 18 or older residing in jurisdictions where the Services are legally available.
2. Trader Representations and Obligations
By using the Services, you represent, warrant, and covenant that:
- You are at least 18 years old, of sound mind, and possess full legal capacity to enter into this Agreement.
- If acting on behalf of an entity or third party, you have unequivocal authority to bind such party to these Terms.
- Your use of the Services does not violate any law, regulation, ordinance, or pre-existing contractual obligation.
- You will provide true, accurate, current, and complete information as requested by ITA.
- You will not assign, transfer, or share your account with any other person or entity without ITA’s prior written consent.
3. Account Registration and Security
To access the Services, you must register an account and maintain the confidentiality of your credentials. You are solely responsible for all activities under your account. Only one active profile is permitted per individual.
4. Know-Your-Customer (KYC) Compliance
ITA reserves the right to require KYC onboarding, including submission of identification documents and personal information, to comply with AML/CFT laws. Failure to comply, or provision of false information, shall entitle ITA to refuse, restrict, or terminate your access without notice or refund.
5. General Conditions
- Right to Refuse Service: ITA retains the unfettered right to refuse, restrict, or terminate service at any time, for any reason.
- Data Transmission: Your content (excluding payment data) may be transmitted unencrypted across networks.
- Prohibited Actions: You shall not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or Services without ITA’s express written consent.
6. Payments and Refunds
All payments for Services are final, non-refundable, and solely for access to simulated trading evaluations. No refunds or cancellations are permitted under any circumstances. See our Return Policy for full details.
7. ITA Evaluation and Funded Stages
Maximum Loss Limits
- 1-Step Model: 6%
- 2-Step Model: 12%
- Instant Model: 6%
- Instant Funding Pro: 6%
Maximum Daily Loss Limits
- 1-Step Model: 3%
- 2-Step Model: 6%
- Instant Model: 3%
- Instant Funding Pro: 3%
Profit Targets (Evaluation Stage)
- 1-Step: 6% (no time limit)
- 2-Step: 6% in phase 1, 4% in phase 2 (no time limit)
Minimum Trading Days
No minimum trading days on Instant, Instant Pro and 1 Step accounts. 2-Step has a minimum of 3 trading days per stage. Funded 2-Step requires minimum 3 profitable days per 15-day cycle.
8. Rules of Demo/Simulation Trading
- Inactivity: Accounts with no trades for 30 consecutive days will be terminated.
- News Trading: Permitted across all accounts.
- Weekend Holding: Permitted on 2-Step and Instant PRO Funded Accounts. Hard breach on Instant/1-Step.
- Overnight Holding: Allowed on all programs.
- Consistency Score: Instant: 15%, 1-Step: 30%, 2-Step: 40%, Instant PRO: not applicable.
Prohibited Trading Practices
You are strictly prohibited from engaging in: gap trading, high-frequency trading, latency arbitrage, hedging, reverse trading, tick scalping, server spamming, opposite account trading, third-party copy trading, excessive risk-taking, gambling behaviour, overtrading, or exploiting platform errors.
9. Intellectual Property
All content on the Site is the exclusive property of ITA or its licensors. You are granted a limited, revocable, non-transferable license for personal use only.
10. Third-Party Links and Services
The Site may include links to third-party websites not controlled by ITA. ITA disclaims all responsibility for their content, accuracy, or availability.
11. Risk Management and Compliance
ITA may perform periodic risk reviews, including mandatory interviews, to detect prohibited activities. Failure to comply may result in service termination and reward forfeiture.
12. Prohibited Uses
You are expressly prohibited from using the Site for any illegal, unethical, or unauthorized purpose; infringing intellectual property rights; engaging in harassment; scraping or hacking; or participating as an owner/employee/affiliate of a competing proprietary trading firm.
13. Disclaimer of Warranties; Limitation of Liability
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. ITA’s total liability, if any, shall not exceed the fees you paid to ITA in the preceding 30 days.
14. Indemnification
You agree to indemnify, defend, and hold harmless ITA from any claims, losses, damages, liabilities, or expenses arising from your use or misuse of the Site or Services, your breach of these Terms, or your violation of third-party rights.
15. Disputes & Arbitration
Any dispute shall be resolved exclusively through final and binding arbitration by a single arbitrator, in English. By agreeing to these Terms, you irrevocably waive the right to bring claims in court or before a jury, and to participate in class actions.
16. Termination
ITA may terminate or suspend your access at any time, with or without cause or notice. Upon termination, all rights granted to you cease immediately, you forfeit all fees paid and claims to rewards.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of St Lucia, without regard to conflict of law principles.
18. Force Majeure
ITA shall not be liable for any failure or delay in performance due to events beyond its reasonable control.
19. Entire Agreement; Severability
These Terms constitute the entire agreement between you and ITA. If any provision is deemed invalid, the remaining provisions shall remain enforceable.
20. No Waiver; Assignment
No waiver of any Term shall be effective unless in writing and signed by ITA. ITA may assign its rights at its discretion; you may not assign yours without prior written consent.
21. Restricted Jurisdictions
ITAfx services are not available to residents of: United States, Canada, Israel, Japan, North Korea, Belgium, Mauritius, and countries under UN/EU sanctions. Attempting to access or use the Services from a restricted jurisdiction constitutes a violation of these Terms and may result in immediate account termination without refund.

Appendix A: Responsible Trading Policy

Obligations
- Exercise caution in trading, steering clear of hasty choices and news-driven transactions.
- Implement effective risk management strategies (e.g., limiting risk to 1% or less per trade).
- Safeguard account capital and consistently evaluate trading performance.
- Adhere to all ITA guidelines and regulations.
Recommended Practices
- Develop and follow well-defined trading strategies.
- Refrain from reckless or speculative trading habits.
- Concentrate on mastering a select group of assets.
- Keep abreast of global events and market trends.
- Step away periodically to prevent excessive trading.
Penalties for Non-Compliance
Potential outcomes include account suspension, limitations on access, or forfeiture of performance-based rewards, at ITA’s sole discretion.
What Is Toxic Trading Flow (ITA FX Definition)
Toxic Trading Flow refers to trading behaviours and practices that pose a risk to both the trader’s account and the stability of our funded trading programs. Examples include: excessive risk-taking, gambling-style behaviour, overtrading, high-frequency trading, arbitrage exploitation, poor money management, and reverse trading or behavioural red flags.
Engaging in Toxic Trading Flow may result in restrictions on leverage or trade sizes, limits on open positions, adjustments to account risk parameters, suspension/termination/closing of accounts, and forfeiture of profits and eligibility for future funding.
